1. ORDER ACCEPTANCE
1.1. All orders placed with Audiobooks Online by the Customer shall constitute an offer to Audiobooks Online under these terms & conditions, subject to availability of the products and to acceptance of the order by a Audiobooks Online. No amendment of these terms & conditions will be valid unless confirmed in writing by a Audiobooks Online authorized representative.
2. DISPATCH
2.1. Audiobooks Online will always try to meet it's customers' delivery requirements but in no event shall Audiobooks Online be liable for any damages or penalty for delays in dispatch or delivery.
2.2. Risks shall pass to the Customer at the time the products are dispatched by Audiobooks Online. Audiobooks Online accepts no liability for loss or damage caused by the carrier.
3. CANCELLATION & RESCHEDULING
3.1. Subject to clause 5.2 any request by the customer for cancellation of an order or for rescheduling of deliveries will only be considered by Audiobooks Online if made at least 24 hours before dispatch of the products, and shall be subject to acceptance by Audiobooks Online.
4. PRICES
4.1. Catalogues, Price Lists and other advertising literature or material used by Audiobooks Online are intended only as an indication as to price and range of goods offered and no prices, description of other particulars contained therein shall be binding of Audiobooks Online.
4.2. All prices are given by Audiobooks Online at the time of order or an ex-works basis and the Customer is liable to pay for transport packing and insurance (if required).
4.3. All quoted or listed prices are based on the cost to Audiobooks Online of supplying the Products to the Customer. If before delivery of the Products there occurs any increase in any of such costs is respect of Products which have not yet been delivered, the price payable may be subject to amendment without notice at Audiobooks Online's discretion.
4.4. All prices are inclusive of Value Added Taxation and any similar taxes. All such taxes are payable to the Customer and will be applied in accordance with UK legislation in force at the tax point date.
5. PAYMENT TERMS
5.1. Invoices are created on the date of dispatch. All goods must be paid for in full before the goods are dispatched. No credit terms are available unless it has been agreed by and confirmed in writing by an authorized representative of Audiobooks Online. For cheque and postal order payments, an invoice can be raised prior to delivery.
5.2. The following methods of payments are accepted: cheque, postal order, Visa, MasterCard, Delta, Solo, Maestro or Switch. We will not accept cash payments via mail order or the website. Google take care of all the card payments (not us you'll be pleased to hear). That means we don't have any access to your details and Google handle all the financial information for us. You might be relieved about that!
5.3. Notwithstanding dispatch and the passing of risk in the Products to the Customer pursuant to clause 3, or any other provision of these conditions, the legal title of the Products shall not pass to the Customer until Audiobooks Online has received in cash of cleared funds payment of the price of the Products and all of the Products agreed to be sold by Audiobooks Online to the Customer for which payment is due.
5.4. Audiobooks Online reserves the right to cease supplies of Products to the Customer at anytime. On such cessation of supplies, Audiobooks Online reserves the right to withdraw any credit facility such that the whole Customer's account becomes due for payment forthwith.
6. SPECIFICATION OF PRODUCTS
6.1. Unless otherwise agreed, the Products are supplied in accordance with the manufacturers standard specifications as these may be improved, substituted or modified. Audiobooks Online reserves the right to increase it's listed price, or to change accordingly in respect of any orders accepted for Products of non-standard specifications
7. PROPRIETY RIGHT IN SOFTWARE PRODUCTS
7.1. The Customer hereby acknowledges that it is its sole responsibility to comply with any terms and conditions of license attaching to Third Party supplied and delivered by Audiobooks Online.
8. REFUNDS/CANCELLATION
8.1 Audiobooks Online want you to be happy with your purchases. Refunds will of course be given for broken, damaged or faulty goods, and we will endeavour to send a replacement by return, or offer a refund in full. If you do wish to obtain a refund, please contact us as soon as possible by email at admin@mi-vox.com or on 01405 861951. Please contact us as soon as you have a problem - we want to help!
You are also entitled to cancel the sales contract within 7 days of the purchase being made, or 7 days from receipt of goods , whichever is the longer. For cancellation of any order, please email admin@mi-vox.com or phone us on 01405 861951 and we'll sort it out immediately, allowing you to cancel the contract. Just let us know, one of our staff will confirm your cancellation and send us the order back. As soon as we receive the goods in full, we will repay the full cost paid to the payment source.
9. WARRANTY
9.1. If any part of the Products should prove defective in materials or workmanship under normal operation or service, such products will be replaced only in accordance with any warranty cover and terms provided by the manufacturer of the Products.
10. DATA PROTECTION
10.1.In accordance to the Data Protection Act, Audiobooks Online will store information about you maintain it's customer records and inform you of other products and services which may be of interest.
